The Regular Meeting of the City Council for October 3, 2022, will be conducted in person at the City of La Habra Council Chamber, located at 100 East La Habra Boulevard, La Habra, California. The City Council Chamber will be open for public seating and speakers when the Mayor opens public comment periods. Effective March 1, 2022, the wearing of masks is no longer required for those entering this facility.
The public is also encouraged to participate in the Regular Meeting of the City Council by submitting written comments via email to cc@lahabraca.gov no later than 5:00 p.m. on Monday, October 3, 2022, or by viewing the meeting live through the City of La Habra website and clicking on "Watch Live" at 6:30 p.m.

That the City Council approve the City Council of the City of La Habra Meeting Minutes of September 19, 2022.

APPROVE THE SECOND READING AND ADOPTION OF
ORDINANCE NO. 1847 ENTITLED: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF LA HABRA, CALIFORNIA, APPROVING ZONE CHANGE 22-02 TO AMEND TITLE 18 ZONING OF THE LA HABRA MUNICIPAL CODE (LHMC), CHAPTER 18.12 SPECIAL DEVELOPMENT STANDARDS, SECTION 18.12.140 OUTDOOR SEATING AREA, MODIFYING THE OUTDOOR SEATING REQUIREMENTS FOR RESTAURANTS AS PER EXHIBIT "A"
That the City Council approve the second reading and adoption of Ordinance No. 1847.

APPROVE DENIAL OF LIABILITY CLAIM OF FRANCISCO RAMIREZ
That the City Council deny the claim of Francisco Ramirez in order to set a definite six-month Statute of Limitations date.

APPROVE A RESOLUTION REAFFIRMING THE REQUIRED FINDINGS TO CONTINUE TO ALLOW REMOTE CITY COUNCIL MEETINGS AS REQUIRED BY AB 361
That the City Council:
A. Receive this report; and,
B. APPROVE AND ADOPT RESOLUTION NO. ______ ENTITLED: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LA HABRA, CALIFORNIA, MAKING THE LEGALLY REQUIRED FINDINGS TO CONTINUE TO AUTHORIZE THE CONDUCT OF REMOTE "TELEPHONIC" MEETINGS DURING THE STATE OF EMERGENCY.

AUTHORIZE THE CITY MANAGER TO EXECUTE AN AGREEMENT WITH YUNEX LLC FOR CITYWIDE TRAFFIC SIGNAL MAINTENANCE SERVICES, FISCAL 2022-2023 THROUGH FISCAL YEAR 2026-2027
That the City Council:
A. Approve and authorize the City Manager to enter into a five-year agreement with Yunex LLC for an amount not-to-exceed $500,000 for Citywide Traffic Signal Maintenance Services, Fiscal Year 2022-2023 through Fiscal Year 2026-2027; and,
B. Authorize staff to issue a purchase order to Yunex LLC in the amount of $100,000 for Fiscal Year 2022-2023.

AUTHORIZE THE CITY MANAGER TO EXECUTE AN AGREEMENT WITH KOA FOR PROFESSIONAL TRAFFIC ENGINEERING DESIGN SERVICES FOR THE HIGHWAY SAFETY IMPROVEMENT PROGRAM (HSIP) CYCLE 9, CITY PROJECT NO. 1-TC-19, FEDERAL PROJECT NO. HSIPL-5266(029)
That the City Council:
A. Approve and authorize the City Manager to execute an agreement with KOA Corporation, of Monterey Park, California, for Professional Traffic Engineering Design Services for the Highway Safety Improvement (HSIP) Cycle 9, City Project No. 1-TC-19, Federal Project No. HSIPL-5266(029); and
B. Authorize staff to issue a purchase order to KOA Corporation in the amount of $132,737, which includes a ten percent (10%) contingency.

WARRANTS: APPROVE NOS. 00135866 THROUGH 00136069 TOTALING $1,732,466.15
That the City Council approve Nos. 00135866 through 00136069 totaling $1,732,466.15.

CONSIDER APPROVAL OF GUIDELINES FOR THE DINE AND SHOP LOCAL INCENTIVE PROGRAM AND APPROVE AN AGREEMENT WITH GIVERRANG IN THE AMOUNT OF $220,000 FOR IMPLEMENTATION OF THIS PROGRAM
That the City Council:
A. Consider and approve program guidelines, application and agreement for the proposed $200,000 Dine and Shop Local Incentive Program;
B. Authorize staff to make minor modifications and revisions to the guidelines, application, and agreement, if necessary;
C. Approve an additional $20,000 appropriation of American Rescue Plan Act funding for implementation costs related to the Dine and Shop Local Incentive Program; and,
D. Approve and authorize the City Manager to execute an agreement with Giverrang in an amount not to exceed $220,000 for implementation of the proposed Dine and Shop Local Incentive Program.
