The Regular Meeting of the City Council for May 6, 2024, will be at the City of La Habra Council Chamber located at 100 East La Habra Boulevard, La Habra, California. The City Council Chamber will be open to the public at 6:00 p.m. and the meeting will start promptly at 6:30 p.m.
The public is encouraged to participate in the Regular Meeting of the City Council by attending in person or submitting written comments via email to cc@lahabraca.gov no later than 5:00 p.m. on Monday, May 6, 2024. Written comments sent to the City by 5:00 p.m. on the day of the meeting will be printed and provided to the City Council prior to the meeting. CONSENT CALENDAR:
| Senate Bill 1439 ("SB 1439") amended Government Code Section 84308 to expand the regulation of campaign contributions in excess of $250 from donors involved in certain matters before the legislative body. If the donor has a matter pending before the agency, and the official received a campaign contribution from the donor in excess of $250 in the prior 12 months, the official must publicly disclose the contribution and cannot in any way participate in the decision of the matter. The donor also has a duty to disclose the contribution on the record. In the 12 months following the decision, a local official cannot receive campaign contributions in excess of $250 from a donor with an economic interest in the governmental decision. Public officials are encouraged to closely track all campaign contributions which collectively exceed $250 in any 12-month period from any single source. |

That the City Council approve the City Council of the City of La Habra Regular Meeting Minutes of April 15, 2024.

APPROVE DENIAL OF LIABILITY CLAIM OF MR. JOSEPH DELANEY
That the City Council deny the claim of Mr. Joseph Delaney in order to set a definite six-month Statute of Limitations date.

APPROVE DENIAL OF LIABILITY CLAIM OF MS. ROXANE ORNELAS
That the City Council deny the claim of Ms. Roxane Ornelas in order to set a definite six-month Statute of Limitations date.

APPROVE DENIAL OF LIABILITY CLAIM OF MR. TRANELL DAVIS

APPROVE COOPERATIVE AGREEMENT WITH THE CITIES OF FULLERTON, ANAHEIM, GARDEN GROVE, SANTA ANA, AND FOUNTAIN VALLEY FOR THE EUCLID STREET CORRIDOR PROJECT, REGIONAL TRAFFIC SIGNAL SYNCHRONIZATION PROGRAM (RTSSP)
That the City Council approve a Cooperative Agreement with the cities of Fullerton, Anaheim, Garden Grove, Santa Ana, and Fountain Valley for the Euclid Street Corridor Project, Regional Traffic Signal Synchronization Program (RTSSP).

APPROVE AN AGREEMENT WITH TROLLER MAYER ASSOCIATES, INC. FOR DESIGN SUPPORT DURING THE CONSTRUCTION OF THE WOMAN'S CLUB PARK PROJECT, CITY PROJECT NO. 1-P-22
That the City Council:
A. Approve and authorize the City Manager to execute an agreement with Troller Mayer Associates, Inc., of Glendale, California in the amount of $55,494 to provide design support during the construction of the Woman's Club Park Project, City Project No. 1-P-22; and,
B. Approve and authorize staff to issue a purchase order to Troller Mayer Associates, Inc. of Glendale, California, in an amount not-to-exceed $61,044, which includes a ten percent (10%) contingency.
9.
APPROVE AGREEMENTS WITH
MDJ MANAGEMENT, LLC. AND FC & SONS ROOFING INC. FOR THE EMERGENCY ROOF REPAIRS AT THE CITY OF LA HABRA CHILD DEVELOPMENT MAIN OFFICE
That the City Council:
A. Approve the waiver of the competitive bidding process per La Habra Municipal Code Section 4.20.070 (A) in case of an emergency as determined by the City Manager;
B. Authorize the City Manager to execute an agreement for Phase I of the City of La Habra Child Development Main Office Roof Improvements with MDJ Management, LLC., and authorize staff to issue a purchase order to MDJ Management, LLC, in the amount of $145,000 which includes a 20 percent contingency;
C. Authorize the City Manager to execute an agreement for Phase 2 of the City of La Habra Child Development Main Office Roof Improvements with FC & Sons Roofing Inc., and authorize staff to issue a purchase order to FC & Sons Roofing Inc., in the amount of $254,326 , which includes a 20 percent contingency, and an additional $70,000 for as needed funding for decking that may require replacement once the project begins;
D. Authorize staff to retain a construction manager and inspector from the City of La Habra Engineering Division's On Call Consultant Agreement to oversee the construction of both phases of the project, and to fund the City of La Habra Building and Safety Permit fees in an amount not to exceed $80,000; and,
E. Approve an appropriation of $339,362.81 from the California State Preschool Contract Grant Fund and $235,828.39 from the General Child Care Contract Grant Fund to fully fund the costs of this project.
10.
APPROVE ISSUANCE OF A PURCHASE ORDER TO PUENTE HILLS FORD, CITY OF INDUSTRY, CALIFORNIA, IN THE AMOUNT OF $138,150 FOR THREE NEW POLICE ADMINISTRATION VEHICLES
That the City Council authorize the City Manager to issue a purchase order in the amount of $138,150 from the Fleet Replacement Fund to Puente Hills Ford, City of Industry, California, for the purchase of three new Police administration vehicles to replace existing vehicles.
11.
APPROVE ISSUANCE OF A PURCHASE ORDER TO KEN GRODY FORD, BUENA PARK, CALIFORNIA, IN THE AMOUNT OF $63,709.90 FOR ONE NEW 2024 FORD F-450 STANDARD CAB PICKUP TRUCK TO REPLACE AN EXISTING FLEET TRUCK
That the City Council authorize the City Manager to issue a purchase order in the amount of $63,709.90 from the Fleet Replacement Fund to Ken Grody Ford, Buena Park, California, for the purchase of one new 2024 Ford F-450 Standard Cab Pickup truck.

APPROVE AND AUTHORIZE THE CITY MANAGER TO EXECUTE A NEW AGREEMENT FOR CONTRACT NO. MA-012-2401395 TO CONTINUE THE CITY OF LA HABRA'S ADMINISTRATION OF A COUNTYWIDE WORKFORCE INNOVATION OPPORTUNITY ACT (WIOA) PROGRAM FOR YOUTH SERVICES WITH THE COUNTY OF ORANGE
That the City Council approve and authorize the City Manager to execute a contract with the County of Orange for the Workforce Innovation Opportunity Act (WIOA) Program to allow the City to continue acting as the sole provider of the County's grant funded "READY S.E.T. OC" Youth Services Program for a one-year term, with three additional optional one-year renewals, in the amount of $2,700,000 for each program year.

RECEIVE AND FILE THE TREASURER'S INVESTMENT REPORT FOR THE QUARTER ENDING MARCH 31, 2024
That the City Council receive and file the Treasurer's Investment Report for the quarter ending March 31, 2024.

That the City Council approve Nos. 00143554 through 00143892 totaling $2,495,086.81.

CONSIDER AND APPOINT ONE INDIVIDUAL TO FILL THE UNSCHEDULED VACANCY ON THE PLANNING COMMISSION, AND CONSIDER AND APPOINT INDIVIDUALS AS ALTERNATES ON THE PLANNING COMMISSION AND COMMUNITY SERVICES COMMISSION
That the City Council:
A. Consider and appoint one individual to fill the unscheduled vacancy on the Planning Commission with a term ending on March 31, 2027;
B. Consider and appoint up to two individuals to serve as alternates on the Planning Commission; and,
C. Consider and appoint up to two individuals to serve as alternates on the Community Services Commission.

APPROVAL OF AWARD OF CONTRACT TO MICON CONSTRUCTION, INC., FOR THE WOMAN'S CLUB PARK PROJECT, CITY PROJECT 1-P-22, AND CONSIDER NAMING THE NEW PARK
That the City Council:
A. Approve the plans and specifications for the Woman's Club Park Project, City Project No.1-P-22;
B. Award a construction contract for the Woman's Club Park Project, City Project No.1-P-22, to Micon Construction, Inc., of Placentia, California, in the amount of $1,559,982 and reject all other bids;
C. Authorize the City Manager to execute an agreement with Micon Construction, Inc., and issue a purchase order in the amount of $1,871,978.40 which includes a 20 percent contingency;
D. Approve an appropriation of $279,057 from the General Capital Projects fund balance to fully fund the Woman's Club Park Project, City Project No 1-P-22; and,
E. Consider naming the new park based on recommendations by the La Habra Woman's Club, the City's Planning Commission, and the City's Community Services Commission.

CITY COUNCIL DIRECTION REGARDING THE RENAMING OF "OLD RESERVOIR PARK"
That the City Council provide direction to staff regarding the renaming of "Old Reservoir Park".
