The Regular Meeting of the City Council and the Regular Joint Meeting with the Successor Agency to the Redevelopment Agency of the City of La Habra, La Habra Civic Improvement Authority, City of La Habra Housing Authority, and the La Habra Utility Authority for December 16, 2024, will be at the City of La Habra Council Chamber located at 100 East La Habra Boulevard, La Habra, California.  The City Council Chamber will be open to the public at 6:00 p.m. and the meeting will start promptly at 6:30 p.m.

The public is encouraged to participate in the Regular Meeting of the City Council and the Regular Joint Meeting with the Successor Agency to the Redevelopment Agency of the City of La Habra, La Habra Civic Improvement Authority, City of La Habra Housing Authority, and the La Habra Utility Authority by attending in person or submitting written comments via email to cc@lahabraca.gov no later than 5:00 p.m. on Monday, December 16, 2024.  Written comments sent to the City by 5:00 p.m. on the day of the meeting will be printed and provided to the City Council prior to the meeting. The meeting can also be viewed live through the City of La Habra website at www.lahabraca.gov/356/Archived-Council-Videos by clicking on "Watch Live" at 6:30 p.m.

The City of La Habra live broadcasts and replays City Council Meetings on La Habra Cable Channel 3 and over the website at www.lahabraca.gov.  Please note that in person attendance at this public meeting may result in the recording and broadcast of your image and/or voice.

SPECIAL ORDER OF BUSINESS:
 
Any member of the audience may request to address the La Habra City Council on the Special Order of Business, prior to the La Habra City Council taking a final vote on the item. Public comment shall be limited to three (3) minutes per individual, with a total time limit of 30 minutes per Special Order of Business, unless otherwise modified by the Mayor. Speaking time may not be granted and/or loaned to another individual for purposes of extending available speaking time, and comments must be kept brief, non-repetitive, and professional in nature.

CITY COUNCIL:
 
1.
APPROVE AND ADOPT A RESOLUTION CERTIFYING THE RESULTS OF THE NOVEMBER 5, 2024, GENERAL MUNICIPAL ELECTION
 

That the City Council APPROVE AND ADOPT RESOLUTION NO. CC 2024-__ ENTITLED: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LA HABRA, CALIFORNIA, RECITING THE FACT OF THE GENERAL MUNICIPAL ELECTION HELD ON NOVEMBER 5, 2024, DECLARING THE RESULTS AND SUCH OTHER MATTERS AS PROVIDED BY LAW.
 
INSTALLATION OF NEWLY ELECTED COUNCILMEMBERS:
Administration of Oath of Office to Daren Nigsarian, Rose Espinoza, and Delwin Lampkin; and presentation of Certificates of Election.
 
PUBLIC COMMENTS: When addressing the La Habra City Council, please complete a Speaker's Card before leaving the Council Chamber.
 
General Public Comments shall be received at the beginning of the governing body meeting and limited to three (3) minutes per individual, with a total time limit of 30 minutes for all public comments, unless otherwise modified by the Mayor or Chair.  Speaking time may not be granted and/or loaned to another individual for purposes of extending available speaking time, and comments must be kept brief, non-repetitive, and professional in nature.

The general Public Comment portion of the meeting allows the public to address any item of City business not appearing on the scheduled agenda. Per Government Code Section 54954.3(a), such comments shall not be responded to by the governing body during the meeting.
 
CONSIDERATION ITEMS:

Speaking time may not be granted and/or loaned to another individual for purposes of extending available speaking time, and comments must be kept brief, non-repetitive, and professional in nature.

CITY COUNCIL:
 
1.
CITY COUNCIL REORGANIZATION AND APPOINTMENTS TO GOVERNMENTAL AGENCIES AND OUTSIDE BOARDS 
 

That the City Council consider and elect/appoint:
A.  Mayor and Mayor Pro Tem for one-year terms (December 2024-December 2025);

B.  Delegate and Alternate representatives to the Orange County Sanitation District for one-year terms (December 2024-December 2025);

C.  Delegate and Alternate representatives to the Southern California Association of Governments (SCAG) for the purpose of attending and voting at the SCAG General Assembly meetings held in 2025;

D.  Two Councilmembers to serve on the City's Internal Audit Committee for one-year terms (December 2024-December 2025);

E.  Delegate and Alternate Representative to serve on the Orange County Library Advisory Board for two-year terms (December 2024-December 2026); and,

F.  Appointment by the Mayor of one Councilmember to serve on the City's Emergency Preparedness Council as Vice Chair for a one-year term (December 2024-December 2025).
 
CONSENT CALENDAR:
 
Senate Bill 1439 ("SB 1439") amended Government Code Section 84308 to expand the regulation of campaign contributions in excess of $250 from donors involved in certain matters before the legislative body.  If the donor has a matter pending before the agency, and the official received a campaign contribution from the donor in excess of $250 in the prior 12 months, the official must publicly disclose the contribution and cannot in any way participate in the decision of the matter. The donor also has a duty to disclose the contribution on the record.

In the 12 months following the decision, a local official cannot receive campaign contributions in excess of $250 from a donor with an economic interest in the governmental decision.  Public officials are encouraged to closely track all campaign contributions which collectively exceed $250 in any 12-month period from any single source.
All matters on Consent Calendar are considered to be routine and will be enacted by one motion unless a Councilmember, City staff member, or member of the audience requests separate action or removal of an item. Removed items will be considered following the Consent Calendar portion of this agenda. Public comment shall be limited to three (3) minutes per individual, with a total time limit of 30 minutes per item that has been removed for separate discussion, unless otherwise modified by the Mayor. Speaking time may not be granted and/or loaned to another individual for purposes of extending available speaking time, and comments must be kept brief, non-repetitive, and professional in nature.

That the City Council  deny the claim of American Automobile Club (AAA) in order to set a definite six-month Statute of Limitations date.

APPROVE DENIAL OF LIABILITY CLAIM OF MR. PEDRO PONCE
 

That the City Council deny the claim of Mr. Pedro Ponce in order to set a definite six-month Statute of Limitations date.
 
4.
APPROVE DENIAL OF LIABILITY CLAIM OF SALMA NASOORDEEN AND HASNI AINI
 

That the City Council deny the claim of Salma Nasoordeen and Hasni Aini in order to set a definite six-month Statute of Limitations date.
 
5.
TAKE ACTIONS RELATED TO COLLECTION AND ADMINISTRATION OF MEASURE V TAX, AUTHORIZATION OF AGREEMENTS WITH CALIFORNIA DEPARTMENT OF TAX AND FEE ADMINISTRATION AND WITH HINDERLITER DE LLAMAS & ASSOCIATES, AND AUTHORIZATION OF USE OF STATE TAX RECORDS
 

That the City Council:
A.  Authorize the City Manager to enter into a Master Services Agreement with Hinderliter de Llamas & Associates (HdL) to provide services in connection with taxes administered by the California Department of Tax and Fee Administration;

B.  APPROVE AND ADOPT RESOLUTION NO. CC 2024-__ ENTITLED: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LA HABRA, CALIFORNIA, AUTHORIZING THE CITY MANAGER TO EXECUTE AGREEMENTS WITH THE CALIFORNIA DEPARTMENT OF TAX AND FEE ADMINISTRATION FOR IMPLEMENTATION OF A LOCAL TRANSACTIONS AND USE TAX; and,

C.  APPROVE AND ADOPT RESOLUTION NO. CC 2024-__ ENTITLED: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LA HABRA, CALIFORNIA, AUTHORIZING EXAMINATION OF SALES OR TRANSACTIONS AND USE TAX RECORDS.
 
6.
APPROVE PARCEL MAP NO. 2023-149 AT 310-330 EAST WHITTIER BOULEVARD, AS SUBMITTED, AND ACCEPT THE DEDICATION FOR PUBLIC HIGHWAY AND PUBLIC UTILITY PURPOSES ON WHITTIER BOULEVARD AND CYPRESS STREET
 

That the City Council approve Parcel Map No. 2023-149 at 310-330 East Whittier Boulevard, as submitted, and accept the dedication for public highway and public utility purposes on Whittier Boulevard and Cypress Street.
 
7.
APPROVE AMENDMENT NO. 1 TO THE LAND LEASE AGREEMENT WITH ORANGE COUNTY HEAD START FOR THE CONTINUED USE OF CITY PROPERTY LOCATED AT 1060 WEST LAMBERT ROAD
 

That the City Council approve and authorize the City Manager to execute Amendment No. 1 to the Land Lease Agreement with Orange County Head Start to extend the term of the lease for City-owned property at 1060 West Lambert Road through June 30, 2038.
 
8.
APPROVE A RESOLUTION CONCERNING THE ANNUAL MEASURE M2 (M2) EXPENDITURE REPORT
 

That the City Council APPROVE AND ADOPT RESOLUTION NO. CC 2024-__ ENTITLED A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LA HABRA, CALIFORNIA, CONCERNING THE MEASURE M2 (M2) EXPENDITURE REPORT FOR THE CITY OF LA HABRA.
 
9.
WARRANTS: APPROVE NOS. 00145321 TOTALING $6,354.25; AND WARRANTS 1636 THROUGH 1880 TOTALING $2,238,375.93; AND APPROVE WIRE TRANSFERS DATED 11/21/24 AND 12/05/24, TOTALING $853,393.79
 

That the City Council approve Nos. 00145321 totaling $6,354.25 and 1636 through 1880 totaling $2,238,375.93; and approve Wire Transfer dated 11/21/24 and 12/05/24, totaling $853,393.79.

APPROVE AND ADOPT THE ANNUAL INVESTMENT POLICY FOR CALENDAR YEAR 2025
 

That the City Council, Successor Agency to the Redevelopment Agency of the City of La Habra, La Habra Civic Improvement Authority, City of La Habra Housing Authority, and La Habra Utility Authority review, approve and adopt the City's Annual Investment Policy for implementation beginning January 1, 2025.
