Resolution amending Right-of-way Obstruction Permit Fees.

City Code, Sec. 6.06. Right of Way Management allows the city to manage activities within public right-of-ways and to charge fees associated with such management. Actual fees are set by the City Council as part of the city’s larger fee schedule. The city charges fees to private development projects for obstruction to the right-of-way. The current fee structure has raised concern from both developers and city staff. 

The City Council, at its Work Session on January 27, 2025, discussed this issue and provided feedback to staff regarding potential changes to the fee schedule. The information contained in this item reflects the feedback given.

Notes:

• Partial Street obstruction includes the closure of travel lanes but requires that a minimum of one lane of traffic in each direction provided on the roadway be maintained. On a two-way road, two travel lanes must be maintained. On a one-way road, only one travel lane must be maintained.
• The city will maintain a map showing which streets are considered Downtown and Arterial/Collector streets for purposes of these fees. 
• Fees will be charged by street face of a given construction project regardless of obstruction length. If multiple development projects obstruct the same street face, each development will be charged construction fees according to this schedule.
• Obstruction Fees are only charged when an Obstruction Permit is required. 
• If ongoing issues arise with the implementation of the new fee schedule, staff will bring the issue back to the City Council with suggested modifications.

Once approved, staff will revise existing permit and guidance documents to reflect the new fees and to clearly communicate their application.
