Resolution approving a Sidewalk License and Maintenance Agreement (418 West 7th Street).
Recommendation/Action(s):
Adoption of the attached resolution.
Summary:
As part of the 2026 construction program, 7th Street is being reconstructed between Owatonna Street and Sibley Street. During the development of this project, the City received significant feedback from property owners against the completion of a sidewalk along the north side of 7th Street between Hubbell Avenue and Sibley Street. The approved plans for this segment of roadway do not include a new sidewalk along the north side of the street. The plans include the removal of two non-continuous segments of existing sidewalk.
The owners at 418 West 7th Street would like the existing sidewalk located in the right-of-way adjacent to their property to remain temporarily – until the end of its useful service life. After exploring various encroachment agreement options, it was determined that a Sidewalk License and Maintenance Agreement was the most practical way to meet both the property owner and the City's needs. A copy of the proposed agreement signed by the property owners is attached.
