APX Construction is requesting to set February 9, 2026, as the date of the public hearing to review a variance to reduce the setback from a wetland from 16.5 feet to 5 feet for the purpose of constructing a sidewalk in the area between Victory Drive and the wetland next to Evenson Subdivison. The property is described as South Victory Drive adjacent to Lot 1, Block 1 Evenson Subdivision (905 South Victory Drive). 

The proposed sidewalk is 5 feet wide and will provide a connection from the proposed apartment complex to the sidewalks on Stadium Road. The Council reviewed and approved Evenson Subdivision on December 8, 2025. A condition of approval was that the sidewalk, not included on the Sidewalk and Trail Map, be reviewed for a license to encroach and a variance. The applicant has submitted the variance application and will also submit the license to encroach for Council review.
