Motion authorizing Request for Qualifications, approving the Selection Committee, and authorizing the release of a Request for Proposals for a Construction Manager at Risk for Capital Improvement Project 11212; the Vetter Stone Amphitheater Improvements.

Recommendation/Action(s):

Motion approving request for Qualifications, approving the Selection Committee, and authorizing the release of a Request for Proposals for a Construction Manager at Risk.

Summary:

Staff have determined that the best method for delivering the improvements for the Vetter Stone Amphitheater involves procurement through a Construction Manager at Risk (CMaR) contract. This will allow for value engineering and constructability reviews throughout the design process and assist with the expedited construction schedule.

Minnesota Statute 471.463 authorizes municipalities to select a Construction Manager to manage the construction process, including but not limited to responsibility for the price, schedule, and workmanship of the construction performed. 

The CMaR is selected using a two-step competitive proposal.

Step One: The owner and design firm prepare a Request for Qualifications with preliminary project information and use qualifications-based criteria to rank and shortlist the top firms. Between 2 and 5 firms will be shortlisted.

Step Two: More detailed design information is provided to the short-listed firms who reply with price information for various items such as profit/contractor fee, preconstruction services, insurance, bonding and general conditions. Release of the Request for Proposal is tentatively scheduled for February 10, 2026.

The recommended Selection Committee includes:
  • Construction and Facilities Director (Construction Experience)
  • Facilities Manager (Construction Experience)
  • Facilities Recreation Coordinator
  • Co-Director of the Civic Center
  • Co-Director of the Civic Center
  • LSE (Professional Architectural and Engineering Services)
Preconstruction services are anticipated at $35,000. The project holds a contingency in the amount of $288,750 and the preconstruction services are proposed to be funded through the contingency.
