AGENDA RECOMMENDATION |
8.D.
City Council Regular Meeting
- Meeting Date:
- 08/08/2022
Agenda Item:
Set August 22, 2022, as the date of public hearing on an Ordinance establishing a prohibition on the possession, use and distribution of edible cannabinoid products by underage persons in public places located in the City of Mankato.
Recommendation/Action(s):
Set August 22, 2022, as date of public hearing.
Summary:
On July 1, 2022, “edibles” containing small amounts of hemp-derived THC became legal in Minnesota. Under the law, Minnesotans, age 21 and older, can buy food and beverages that contain up to 5 milligrams of THC per serving, with a limit of 50 milligrams per package. The law does not prohibit the possession of these edibles by minors (those under 18). As such, we desire to create a narrow scope ordinance adding a section to the City Code that allows our Public Safety staff to remove “edibles” from the possession of minors if they are found. We intend to hold them in safekeeping and will notify the guardians of the minors and will return them to them.
Staff is recommending calling for a public hearing on the attached draft ordinance for August 22, 2022 at 6:00 p.m.
