During the development of the Germania Park Masterplan, it was noted that the neighborhood has 80-foot wide rights-of-way.  The typical residential street has a 60-foot wide right-of-way.  This wider than typical right-of-way creates several encroachment and setback violations.  It was recommended that upon completion of the improvement projects that 10 feet of right-of-way be vacated on either side of the streets within the residential neighborhoods. The vacation would be centered on the existing street, and those areas that have previously vacated a portion of the right of way would not vacate additional area. This would allow for many of the violations to come into conformance.  

During this initial information gathering step, staff is seeking input regarding the vacation from partners and utility providers about the proposed vacation and whether additional easement may be necessary in the proposed vacation areas. The next step will include the preparation of the official vacation surveys, public notifications, and hearings.
