Resolution approving update to the Transit Procurement Plan.

Summary:

This procurement policy is an update to the revised February 2021 policy, incorporating recent federal procurement requirements, and guiding the way departments work together to fulfill procurement goals.

Federal Transit Administration (FTA) regulations (2 CFR § 200.319(c) and FTA Circular 4220.1F, Chapter III, § 3a) require written procurement procedures when utilizing federal and state funds.  This policy is designed to meet FTA and Minnesota Department of Transportation (MnDOT) requirements in this regard.

This policy establishes guidelines and minimum standards for use in the management of third-party contracts.  This manual is intended to ensure compliance with the Federal Transit Administration (FTA) and the Minnesota Department of Transportation’s standards to ensure full and open competition and equitable treatment of all potential sources for all purchases made with funding derived from the federal, state, and local governments.  In all purchasing activity, the goal is to ensure maximum open and free competition consistent with:
  • General Procurement Standards, 2 CFR § 200.318 – 200.327
  • Third Party Contracting Guidance, FTA Circular 4220.1F, Revision 4, dated March 18, 2013
  • FTA Best Practices Procurement & Lessons Learned Manual, FTA Report No. 0105, dated October 2016
  • City of Mankato Financial Management Policies, May 22, 2023
     
The goal of this procurement policy is to provide an atmosphere in which all procurement transactions will be conducted in a manner providing full and open competition while preventing the use of state or federal funds for unallowable costs, as discussed in 2 C.F.R. 200 and other applicable regulations.
