The property is the former location of the "Karshe Tea" café. The café has not been used for over 12 months. In addition to the restaurant space, the building contains 2 upper story apartments.

Review
The applicant, Bennett Coughlan, is requesting a conditional use permit to allow for a restaurant use in the CBD-F, Central Business District Fringe, zoning district.
The property is the former location of the "Karshe Tea" restaurant. The restaurant has not been used for over 12 months. Because of this, the Conditional Use Permit previously approved for a restaurant at that location would no longer apply and a new Conditional Use Permit would be required.
Bosphorus Gyros & Kebab House is the proposed tenant of the first floor space, encompassing approximately 1,700 square feet, and offering a variety of menu items. In addition to the restaurant space, the building contains 2 upper story apartments. No changes to the upper story apartments are associated with this project, but parking requirements for all uses shall still be met. The floor plan depicts 40 customer seats, 24 seats within the building and 16 seats on an outdoor patio space. The customer seats shown are arranged with four-person and two-person tables. A retail counter / order counter, kitchen, and restroom are shown. The existing kitchen is proposed to remain as it has been left by the previous use. Trash is proposed to be stored within an exterior garage along West Liberty Street.
The proposed use will have 2 employees on a major shift, composed of kitchen and counter service staff. They propose having 2-6 total employees for the restaurant. The restaurant is proposing 11:00 am to 9 pm Monday–Thursday, 11:00am to 3:00am Friday–Saturday, and 11:00am to 8:00pm Sunday hours of operation, and it will be open 7 days per week.
The applicant has indicated there will be no delivery vehicles associated with the business (this does not refer to third-party food delivery services) nor will they serve alcohol at this time.
The applicant has not provided any plans showing proposed exterior modifications to the building.

Plans show an outdoor patio on the Liberty Street side of the property with four tables, each with four chairs within an outdoor patio area. The patio area is also shown to contain a bike rack. As shown, the patio would not encroach onto the public right of way, but if an encroachment occurs, a license to encroach application would be required.

The applicant has provided a copy of a purchase agreement between 630 S Front Street, LLC. (as buyer) and Jeffery H. Pamer (as seller). Bennett Coughlan, the applicant, is the Managing Member of the aforementioned Limited Liability Company. The purchase agreement consists of approximately .23 acres divided between two parcels (R01.09.18.151.009 & R01.08.13.277.005), parcels that are located immediately to the NW of the subject property. The two parcels currently operate as parking areas for 634, 630, and 620/626 S Front Street. The aforementioned properties are owned by the applicant and the applicant has provided a parking analysis for the businesses using the shared parking area. The site plan and parking analysis that was submitted showed that 29 parking stalls, including one accessible stall, would be provided in the shared parking area.
