Consideration of Emergency Ordinance Clarifying Requirements for Law Enforcement Agencies and Officers within the City.
Recommendation/Action(s):
Adoption of proposed Emergency Ordinance.
Summary:
The City Council has requested the creation of a draft ordinance that would require law enforcement agencies and officers to wear a body camera, be unmasked, and provide identification on their person.
Since the last meeting, staff has identified a provision that would allow the City Council the ability to adopt or reject the emergency ordinance with or without amendment at the meeting at which it is introduced. To adopt it, it does require an affirmative vote of at least five members. After adoption, the ordinance becomes effective either upon adoption or at such later time as Council specifies. The City’s Charter also provides for automatic adoption, stating that the ordinance repeals on the 61st day after its adoption. The Charter also allows for the Council to consider an extension if the emergency still exists.
For the Council’s consideration, the draft ordinance has been prepared. In addition, a memo from the City Attorney that reviewed important considerations relative to the ordinance.
