Resolution authorizing the City Manager to enter into an agreement with Bolton & Menk, Inc. to provide construction engineering services for Groh Farm Subdivision No. 2; Improvement Project 11003.

Summary:
On December 12, 2022, the City Council approved a Resolution of Final Plat for the Subdivision known as Groh Farm Subdivision No. 2. An attachment to the council and a condition of the approval was the requirement for execution of a subdivision agreement known as Groh Farm Subdivision No. 2 between Drummer Land Investments, LLC and the City of Mankato. The purpose of the subdivision agreement is to provide for the construction of improvements required to provide public improvements to the Subdivision, and to provide for a method to secure the conforming construction of the improvements. The subdivision agreement was fully executed in November 2023. However, construction was delayed while the Developer worked to secure purchase of the necessary wetland replacement credits.
At the time of this report, the Developer has secured all necessary wetland credits and permits to start construction. The contractor has conducted a pre-construction meeting and has submitted an estimated construction schedule which shows the work being completed in two phases over the course of the remainder of this year and next year. All work is expected to be substantially completed by the end of September 2027. Final completion is expected by the end of 2027. Due to the time-lapse since the original Subdivision Agreement, a First Amendment has been executed between Drummer Land Investments, LLC and the City of Mankato, mutually amending the final completion date through December 31, 2027.
In order to facilitate the construction of this project, staff recommends authorizing the City Manager to enter into a professional services agreement with Bolton & Menk, Inc. for construction services for the Groh Farms Subdivision No. 2 project in the amount of $275,000. As outlined in the Subdivision Agreement, the payment for this work is the responsibility of the developer and billed to the Subdivider in the amount of the actual costs incurred.
