Subject: Resolution 24-R-99 - Authorizing an Improvement Agreement for the Den Ott Hill Development for ROW acquisition reimbursement and to acquire ROW from SCUCISD. (S.Williams/B.James) 

BACKGROUND

The developer of the Den-Ott Hill property, that is currently in for zoning at the City Council (Ordinance 24-S-146) is seeking to provide for the ability to access the property via an extension of Ripps-Kreusler Boulevard. This extension needs to cross property owned by SCUCISD. Generally, staff of SCUCISD is supportive of entering into an agreement to sell the right-of-way needed for the Ripps-Kreusler Boulevard to the City, based on the value determined by an appraisal, with the condition that the section of street be constructed. The City would enter into an agreement with the developer of the Den Ott Hill property that would obligate the developer to reimburse the City for the cost of the right-of-way and construct the section of street, including to have to post a surety at the time of execution of the agreement. The City would then enter into an agreement with SCUCISD, assuming the SCUCISD board approves it, for the purchase of the right-of-way based on the value set by an appraisal and that requires the construction of the section of street within a set time frame.

The developer has indicated that if the zoning is not approved they would not want to execute the agreement, but would like the City to approve it, to demonstrate a path forward for one option to provide access to their property.

GOAL

Provide for the necessary dedication of right-of-way for the future extension of Ripps-Kreusler Boulevard to allow for the construction of an approximately 650 foot segment at no cost to the City.

COMMUNITY BENEFIT

Provides for the timely construction of public improvements in a cost effective manner.

SUMMARY OF RECOMMENDED ACTION

Approval of the agreements to allow the City to acquire the needed right-of-way for the extension of Ripps-Kreusler Boulevard from SCUCISD and approval of an agreement that obligates the developer of the Den Ott Hill property to pay for the cost of right-of-way acquisition and construct this segment of street.

FISCAL IMPACT

There is no cost to the City, as the developer will bear the cost of the right-of-way purchase and constructing the section of Ripps-Kreusler Boulevard.

RECOMMENDATION

Approval of Resolution 24-R-99.
