BACKGROUND
The developer of the property at IH-10 and Loop 1604, C5LC at Interstate 10, LLC is seeking a roadway capital recovery offset agreement. Per the City's roadway impact fee ordinance, developers who construct roads listed on the Roadway Impact Fee CIP are eligible for credits that can be used to offset the roadway impact fees due for the project. In this case the agreement provides that no roadway impact fees will be due and no offset credits will be reimbursed by the City for roads the developer is constructing. Meritage Homes is constructing the Carmel Ranch Subdivision on Lower Seguin Road. As part of that project, the developer is constructing portions of Lower Seguin Road and Carmel Ranch Drive. It is estimated that the developer will have 20 excess vehicle miles of capacity for which they can apply for reimbursement. The value of these offsets is approximately $20,000.00 that can be paid from roadway impact fees collected in this service area.
The resolution authorizes the City Manager to execute the attached roadway impact fee offset agreements.
