BACKGROUND
The City, as part of the Texas Department of Transportation (TxDOT) IH 35 NEX project, conducted a public bid opening on August 21, 2025. This project was for the relocation of wastewater facilities within the limits of the TxDOT project. The City only received one bid in the amount of $2,908,642.78. The design engineer’s opinion of probable construction costs (OPCC) is $2,095,110.05 as outlined in the Standard Utility Agreement that the City has with TxDOT (Resolution 25-R-024). TxDOT has indicated that for the City to get reimbursed for amounts exceeding 125% of the agreement, that a separate supplemental agreement would need to be executed.
City Engineering and Purchasing Staff will work to rebid the project with the expectation of additional bidders and bid amounts more in line with the design engineer's OPCC.

GOAL
The goal of Resolution 25-R-133 is to reject the sole bid that was received on August 21, 2025 for the IH 35 NEX Non-Joint Bid Wastewater Project.
COMMUNITY BENEFIT
The proposed improvements are necessary to avoid conflict with the proposed TxDOT improvements as part of the IH 35 NEX Project. Rejecting of the single bid will allow the City to re-bid the project with the goal of receiving multiple competitive bids by qualified contractors.
SUMMARY OF RECOMMENDED ACTION
Staff recommends approval of Resolution 25-R-133 authorizing the rejection of the bid received due to it exceeding 125% of the engineer’s estimated construction cost.

Approve Resolution 25-R-133.
