Subject: Resolution No. 20-R-30 - Consideration and/or action approving a Resolution accepting the appraised value offer of the Texas Department of transportation (TxDOT) to acquire a parcel of land needed for the IH-35 NEX project, and other matters in connection therewith. (B. James/K. Woodlee)

BACKGROUND

The Texas Department of Transportation (TxDOT) is working on a project to expand IH-35 from AT&T Parkway in San Antonio to FM 1103 in Schertz.  The project is referred to as the "IH-35 NEX" project.  In order to construct and operate the planned improvements, portions of numerous properties along the current right of way are needed and are proposed to be purchased by TxDOT.  One of those parcels is owned by the City of Schertz.  The parcel identified as "Parcel 124" is located on the southbound side of IH 35, and is part of the Schertz Fire Station No. 2 property.  The street address is 19085 IH-35 N (see attached Exhibit A).  TxDOT had a survey and appraisal performed for the parcel.  Below is a summary of information regarding the City-owned parcel.

GOAL

The goal of this resolution is to accept compensation from TxDOT to provide necessary right of way for the IH-35 NEX project within the City of Schertz.

COMMUNITY BENEFIT

Once necessary rights of way for the project have been acquired, TxDOT will be able to proceed with construction of the IH-35 NEX project.

SUMMARY OF RECOMMENDED ACTION

It is recommended that the City of Schertz accept TxDOT's offer to acquire Parcel 124 as right of way for the IH-35 NEX project.

FISCAL IMPACT

The City of Schertz will receive $1,715 in compensation for the property.

RECOMMENDATION

Staff recommends that City Council approve Resolution 20-R-30, accepting the appraised value offer from TxDOT for the minor parcel needed as right of way for the IH-35 NEX project, and authorizing the City Manager to execute all documents as required for the transaction and closing.
