Subject: Resolution No. 21-R-24 - Consideration and/or action approving a Resolution authorizing an agreement with the developer of the Parklands II Subdivision project for construction of certain Public Improvements. (B. James/K. Woodlee)

BACKGROUND

The Parklands II Subdivision is a 60.8-acre planned development of 214 single family residential lots located southeast of the Parklands Subdivision in the northeastern-most corner of Schertz (see attached Master Development Plan).  The subdivision is bounded on the south by a residential collector roadway identified on the City's Master Thoroughfare Plan.  The City's Unified Development Code (UDC) requires dedication of right way and construction of adjacent thoroughfares in order for a final plat to be filed.

The master plan for the Parklands II calls for the subdivision to be developed in four separate units, each of which are adjacent to a segment of the thoroughfare.  The only planned connection to the roadway is located in Unit 4.  The segments of the roadway adjacent to Units 1 through 3 will not be accessible to anyone until the connection is made with Unit 4.  The proposed Subdivision Improvement Agreement provides for the developer, Scrappy Development, LLC, to defer the obligation to construct the thoroughfare until Unit 4 of the Subdivision — or for four years, whichever is sooner.  There is a provision for the agreement to be extended if appropriate and approved by City Council. The developer is required to post a surety for 125% of the cost of the road improvements.

GOAL

The goal of Resolution 21-R-24 is to allow development of the Parklands II Subdivision to proceed in a manner mutually beneficial to the developer and the City.

COMMUNITY BENEFIT

Deferral of the obligation to construct the roadway is in keeping with the strategy of promoting the orderly growth of development in the City.  Allowing the deferral of construction of a thoroughfare road until such a point during development when the road will be accessible and useful for vehicular traffic will save the City time and expense of maintaining the roadway segment and the road will not be subject to deterioration before it is useful to anyone in the community.

SUMMARY OF RECOMMENDED ACTION

Staff recommends that Council approve Resolution 21-R-24.

FISCAL IMPACT

There is no fiscal impact to the City related to this resolution.

RECOMMENDATION

Approve Resolution 21-R-24 authorizing the City Manager to execute a Subdivision Improvement Agreement with the developer of the Parklands II Subdivision.
