Subject: Resolution 24-R-90 - Authorizing an agreement to allow construction of a sewer line across public parkland, in addition to dedicating right-of-way (ROW) in existing parkland for secondary access for additional development in the Hallie's Cove subdivision in exchange for funding public park improvements and dedication of land. BACKGROUND

Council approved Resolution 23-R-128 authorizing an agreement with the developer of the Hallie's Court subdivision (adjacent to Hallie's Cove) to:
i. Dedicate additional parkland from Developer-owned land to enlarge the existing City-owned parkland adjacent to the Property.
ii. Pay $30,000 to be used to construct park improvements in parkland adjacent to the additional parkland dedication.
iii. Construct a street, in conformance with City standards, across the City-owned parkland.
This agreement was never executed.

After proceeding further along in the planning process, the Developer's team discovered the need for a sewer line to be constructed across public parkland in a separate location from the already agreed upon right-of-way for the street construction.  Additional public benefit in the amount of $5,000 was negotiated to construct the sewer line across public parkland.  The Parks & Recreation Advisory Board considered the request at their July 22, 2024 meeting and recommended approval to the City Council for their consideration.
The proposed agreement covers the obligations from the original agreement and the new request. So if approved the old agreement will not be executed as this new agreement covers everything. 

GOAL

The goal is to allow the construction of the sewer line across public parkland for the benefit of the development while providing a public benefit in the form of additional funding to be used to construct park improvements.

COMMUNITY BENEFIT

The community will benefit from additional funding to construct additional park improvements.

SUMMARY OF RECOMMENDED ACTION

Approve Resolution 24-R-90.

FISCAL IMPACT

The city will receive $5,000 in additional funds from the developer of the Hallie's Court subdivision.

RECOMMENDATION

Approve resolution 24-R-90.
