CITY COUNCIL MEMORANDUM
| City Council Meeting: | August 19, 2025 |
| Department: | Executive Team |
| Subject: | Resolution 25-R-077 - Authorizing an Agreement for the Rumpf Property for drainage ROW and easement acquisition and reimbursement and to acquire drainage ROW easements from SCUCISD (S.Williams/B.James) |
BACKGROUND
The developer of the Rumpf property is seeking to provide for offsite drainage and utilities. These improvements need to cross property owned by SCUCISD. Generally, staff of SCUCISD is supportive of entering into an agreement to sell the drainage right-of-way and easements needed for these improvements to the City, based on the value determined by an appraisal, with the condition that a fence be constructed. The City would enter into an agreement with the developer of the Rumpf property that would obligate the developer to reimburse the City for the cost of the drainage right-of-way and easements. The City would then enter into an agreement with SCUCISD, assuming the SCUCISD board approves it, for the purchase of the drainage right-of-way based on the value set by an appraisal.
GOAL
Provide for the necessary dedication of drainage right-of-way and easements that potentially serve a number of properties at no cost to the City.
COMMUNITY BENEFIT
Provides for the timely construction of public improvements in a cost effective manner.
SUMMARY OF RECOMMENDED ACTION
Approval of the agreements to allow the City to acquire the needed drainage right-of-way ane easements from SCUCISD and approval of an agreement that obligates the developer of the Rumpf property to pay for the cost of the acquisition and constructing the improvements.
FISCAL IMPACT
There is no cost to the City, as the developer will bear the cost of the right-of-way and easement purchase and constructing the improvements.
