The Water and Wastewater Easement Agreement was recorded on November 29, 2022. This agreement allowed the water and sanitary sewer facilities to be constructed within the easement property in connection with the Parklands II Unit 1 development.  The area of the easement has been platted into right of way as the subdivision has expanded into a new unit, so the easement is no longer needed.  The easement document requires that its release be authorized through a resolution or ordinance approved by City Council.

The goal of this resolution is to authorize the release and termination of the water and wastewater easement across the Parklands II Unit 1 recorded as Document Number 20229903581 in the Official Public Records of Guadalupe County, Texas.

It is the City's desire to promote safe, orderly, efficient development and ensure compliance with the City's vision of future growth. The release of the easement provides a cleaner public record without the encumbrance of an easement across a City right of way.

Staff recommends approval of Resolution 26-R-101 which will authorize the release of the Water and Wastewater Easement Agreement for Parklands II Unit 1.
