SUMMARY:

An Arizona court case has ruled that a decision to appeal must be made in open session in order for an appeal in a court case to be authorized by the governing body. (The case is attached, Johnson v. Tempe Elementary School Dist. No. 3 Governing Bd.)

The appellate court ruled on the motion for reconsideration on September 14, 2017.  The rules allow only 15 days to petition to the Supreme Court of Arizona.  Legal advice has been provided in the prior agenda item.

This agenda item is for Council to decide whether to appeal.
