ITEM:

Discussion and possible action on any and all matters regarding Resolution No. 2035. A Resolution of the Mayor and City Council of the City of San Luis, Arizona adopting fees for small wireless facilities; repealing any conflicting provisions, and providing for severability.  (Kay Marion Macuil, City Attorney)

SUMMARY:

On January 10, 2018, City Council passed Ordinance No. 377 which approved form license agreements for small wireless facilities in the city's right of way and on light poles.  The Arizona Legislature in 2017 passed HB 2365 (ARS Sections 9-591 through 9-599 and 11-1801 through 1810) which allowed small wireless facilities to be installed "by right" on any public street and on light poles.  Resolution No. 2035 sets fees as follows:

Application Fee – New or Replacement Pole . . . . . . . . . . . . . . .. . . . . . . $750.00 
 Annual Right of Way Use Fee. . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . .. .$ 50.00             (for each facility in city’s right of way or utility easements)
 Annual City Pole Use Fee . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . .  . $ 50.00             (for each facility installed on a city-owned pole or on a city-owned wireless support structure in the city’s right of way or utility easements)

This fee has been noticed in the City of San Luis's website for the requisite 60 days.

RECOMMENDATION / SUGGESTED MOTION:

I MOVE TO APPROVE AND ADOPT RESOLUTION 2035.

It is not expected that there will be many applications for small wireless facilities to be placed on public streets or on light poles. Any cost or revenue to San Luis is expected to be negligible.
