ITEM:
Discussion and possible action on any and all matters regarding Resolution No. 2151. A resolution of the Mayor and City Council of the City of San Luis, Arizona, declaring as a public record those certain documents filed with the City Clerk and entitled “NFPA 1, Fire Code 2018” and “City of San Luis Amendments to NFPA 1, Fire Code." (ITEM CONTINUED FROM SPECIAL COUNCIL MEETING HELD DECEMBER 22, 2020.) (Glenn J. Gimbut, Assistant City Attorney)
SUMMARY:
Under A.R.S. § 9-812 and § 39-204, ordinances passed by City Council must be published in the newspaper. To avoid publishing the entire volume of the NFPA 1, Fire Code 2018 and the 10-page City of San Luis Amendments to NFPA 1, Fire Code 2018,
A.R.S. § 9-802 allows adoption by reference to three (3) copies of public records in existence and filed with the City Clerk. This Resolution declares the NFPA 1, Fire Code 2018 and the City of San Luis Amendments to the NFPA 1, Fire Code 2018 to be public records. As public records, they may be referenced in an ordinance to adopt them without publishing the voluminous pages in the newspaper at an extraordinary cost. The next item on the agenda is Ordinance 405, which adopts said code and amendments by reference.
