ITEM:
Discussion and possible directions to staff regarding the Border Area Taxi Vehicle Permit and parking fine for use of public parking as a taxi stand in the Border Area Taxi Stand. (Kay Marion Macuil, City Attorney)
SUMMARY:
A draft fee resolution, a draft clean-up ordinance, and a draft parking fine ordinance are attached. Staff requests the City Council's direction on these drafts.
Fee Resolution
In addition to the $24.00 fee passed in December, there is a proposal to extend through 2021 the $50 fee paid for the 35 vehicles in 2020. For vehicles that did not get a permit in 2020 but are among the 35 vehicles for 2021, the $24 fee would apply. The 35 vehicles are on a first-come, first-served basis. Substitutions within the same transportation business may substitute vehicles as long as the business does not exceed the number of vehicles it got permits for in 2020. For vehicles in excess of the business's number in 2020, the $24.00 would apply.
Clean up Ordinance
To change the fee, Ordinance No. 393 will need to be amended to remove the $50 fee. There are other minor clean-up changes highlighted in yellow on the second attachment to this agenda.
Parking Fine for the Border Area in the Attached Map
The purpose of the limit of 35 permits to use the city's border taxi stand was to increase traffic safety and reduce pedestrian and vehicle conflicts. The city has received complaints that taxis are unlawfully using public parking to set up taxi stands, which could lead to a proliferation of vehicles at the border near the pedestrians. It is proposed the minimum fine for that offense in the border area be increased to a minimum of $250, which is the maximum allowed under A.R.S. § 28-1598. The area where the $250 fine would apply is shown in the map, the last attachment to this agenda.
