Discussion and possible action regarding Ordinance No. 407.  An Ordinance of the Mayor and City Council of the City of San Luis Arizona Amending the City Code Section 112.99 establishing a minimum fine in the “Border Area” for conducting taxicab business on public property not designated as a border area taxi stand or border area waiting stand.; repealing any conflicting provisions; providing for severability; and imposing a penalty (Kay Marion Macuil, City Attorney)

SUMMARY:

At the January 6, 2021, Work Session, three (3) taxi regulations were under discussion, including a minimum $250 parking fine for the Border Area. (Please see the attached map for the Border Area previously designated in Ordinance No. 393)

The purpose of the limit of 35 permits to use the city's border taxi waiting stand was to increase traffic safety and reduce pedestrian and vehicle conflicts. The city has received complaints that taxis are unlawfully using public parking to set up taxi stands, leading to a proliferation of vehicles at the border near the pedestrians.  It is proposed the minimum fine for that offense in the border area be increased to a minimum of $250, which is the maximum allowed under A.R.S. § 28-1598.  The area where the $250 fine would apply only to the Border Area as shown in the map, the last attachment to this agenda item.

It is hoped that the fine $250 will have a deterrent effect and there won't be much difference to public treasury due to the fine.
