ITEM:

Discussion and possible action on any and all matters regarding Resolution No. 2159.  A resolution of the Mayor and City Council of the City of San Luis, Arizona authorizing and directing the entering into a Development Agreement with the Greater Yuma Port Authority (GYPA) to phase the development of Magrino Industrial Park, Unit 3.  (Kay Marion Macuil, City Attorney)

SUMMARY:

Background
The Greater Yuma Port Authority (the "GYPA") is an Arizona non-profit corporation whose members are the City of San Luis, the City of Yuma, the County of Yuma and the Cocopah Tribe.  GYPA in the process of expanding the development of infrastructure for its property, Magrino Industrial Park, which is in the area of the Commercial Land Port of Entry 2 (POE2) in the east mesa of San Luis.  Like other developers, GYPA is phasing the development for an area called Unit 3 of the industrial park. Because the city approved it as one subdivision, the attached development agreement is needed.

As authorized by City Council on June 24, 2020, the city applied for and was awarded the Arizona Department of Transportation's Economic Strength Program Grant to help fund the underground utilities and road construction for Unit 3. (Attached are the agreements with GYPA regarding the Grant and the Grant Agreement with ADOT).  The funding will go towards the infrastructure for Unit 3.

The Basic Terms 
The GYPA will phase development of Unit 3 infrastructure, and that each phase of the development will be considered its own project.  Each phase will go through the city’s approval process independently of the other phases as if each phase were its own subdivision.  GYPA may post financial assurances with the city separately for each phase.  Details of the phasing are Exhibit A to the IGA under consideration now.  (Please see the attached).  The first phase must be completed in 18 months as required by the Arizona Department of Transportation’s State Economic Strength Project Funds Grant for underground utilities, drainage and road construction.  All phases are to be completed within five (5) years.

Recommendation
Staff recommends the adoption of the agreement.
