Discussion and possible action on any and all matters regarding Subdivision Case No. 2020-0605F.  A request by Vega and Vega Engineering, PLC, on behalf of Comite de Bienestar Inc., owner, for the final plat approval for Bienestar Estates 11 Subdivision to be located on the southeast corner of San Antonio Street and 19th Avenue, San Luis, Arizona.   (Jose A. SUMMARY:

This item is a request by Vianey R. Vega P.E., of Vega & Vega Engineering, PLC, on behalf of Comite de Bienestar Inc., owner, for approval of the final plat for the construction of residential subdivision to be called Bienestar Estates 11 Subdivision. 

The subject property is located on the east mesa of the City of San Luis on the southeast corner of San Antonio Street and 19th Avenue, PID# 227-15-028. Immediately to the north is the property where the City of San Luis will be constructing a park. Santa Cecilia No. 1 and Santa Cecilia No. 2, two single-family residential subdivisions, are located north of 24th Street.  To the west Bienestar Estates 10 residential subdivision. South there is undeveloped land zoned as Residential (R1-6). Adjacent to the east is vacant land rezoned from Light Industrial to Residential where a residential subdivision Belleza Del Desierto.

The proposed subdivision consists of approximately 19.19 acres and is proposed to be divided into 94 lots. The lots will range in size from approximately 6,022.96 square feet to 10,150.51 square feet. The retention basin will be located on a City property to the north where a future community park will be located.

GENERAL PLAN :
This area is designated as Medium Density Residential (MDR) in the City of San Luis 2040 General Plan. The activities proposed will be consistent with those designations (Chapter 2, Page 2-10).

AGENCY REVIEW:
As part of the review process, all land use cases are reviewed by various City and outside agencies. We have received comments from the following agencies:
  1. San Luis Fire Department (8-17-20)
  2. Yuma County Airport Authority (8-17-20)
ANALYSIS:
In 2007, the Arizona Legislature adopted legislation that required municipalities to certify that all new subdivisions had an assured 100-year water supply. On February 11, 2011, the City of San Luis was designated by the Arizona Department of Water Resources (ADWR) as having a 100-year adequate water supply. Consequently, individual subdivisions do not have to submit additional certification. 

PLANNING AND ZONING COMMISSION MEETING:
This item was presented to the Planning and Zoning Commission meeting during their regular meeting held on October 13, 2020. The Commission recommended approval of the request with the condition that the applicant had to address all comments in letter dated October 11, 2020, before scheduling this item to be presented to the City Council.

Staff received the resubmittal on February 22, 2021. After review, staff sent out comments letter dated March 18, 2021, to the applicant. Staff received revised plans on April 8, 2021, and are under review by staff.

Staff recommends approval of Subdivision Case No. 2020-0605F with the condition that the applicant addresses review comments letter dated March 18, 2021.

RECOMMENDATION / SUGGESTED MOTION:

I MOVE TO APPROVE SUBDIVISION CASE NO. 2020-0605F WITH THE CONDITION THAT THE APPLICANT ADDRESS STAFF'S MARCH 18, 2021, LETTER TO THE APPLICANT AS PRESENTED.
