ITEM:

Discussion and possible action on any and all matters regarding Order No. 2021-7.  An order of the Mayor and City Council of the City of San Luis, Arizona authorizing and directing the acquisition of all property necessary for the completion of construction of the Mesa Street improvements project, including Mesa Street, Mesa Street Alley located between C and E Streets and neighboring and surrounding rights of way within the City of San Luis by dedication, donation, purchase, exchange, or under the power of eminent domain as a matter of public necessity.  (Mary French Jones, Grant Writer and Kay Marion Macuil, City Attorney) 

SUMMARY:

The City Council approved the submission of a Community Development Block Grant (CDBG) Regional Account application for the Mesa Street Improvements' application to the Arizona Department of Housing (ADOH). As part of the project, the staff requires the acquisition of private property for the development of Mesa Street and ADA compliant handicap ramps. Staff requires authorization from City Council to start negotiations of land acquisition for these properties from five private property owners. Order No. 2021-7 authorizes staff to enter into negotiations or condemn land if necessary to construct the Mesa Street Improvements Project.

The City Council approved the capital project funding for the Mesa Street Improvements, CDBG-RA in the amount of $540,171.00 and CDBG-RA Match in the amount of $486,319.00. The match is 50% general fund and 50% HURF. The expenses incurred by the acquisition of land was not included in the funding allocation of the match. Staff will begin expensing this cost from the capital projects fund. Should the fund be depleted at the end of the project, staff will request council contingency funds to complete the project.

RECOMMENDATION / SUGGESTED MOTION:

I MOVE TO APPROVE ORDER NO. 2021-7 AS A MATTER OF PUBLIC NECESSITY.

The City Council approved the capital project funding for the Mesa Street Improvements, CDBG-RA GL 255-210-90010 in the amount of $540,171.00 and CDBG-RA Match GL Account 255-210-90010 in the amount of $486,319.00. The match is 50% general fund and 50% HURF. The expenses incurred by the acquisition of land was not included in the funding allocation of the match. The estimated cos is approximately $60,000.00. Staff will request council contingency funds if the project requires further funding for the project.
