ITEM:

Discussion and possible action on any and all matters regarding Resolution No. 2356.  A Resolution of the Mayor and City Council of the City of San Luis, Arizona, reducing the City Council Members' pay by fifty percent and amending the City of San Luis Personnel Policies to remove City Council Members from dental and vision care coverage paid by the city; establishing an effective date; repealing any conflicting provisions; and providing for severability.  (Kay Marion Macuil, City Attorney)

SUMMARY:

This item was before the City Council at the last regular meeting as Resolution 2353. A new number is assigned since the motion failed.

This item proposes to reduce the City Council Members' pay by fifty percent (50%) and remove the City Council Members' dental and vision care benefits paid by the city. Finance staff have provided a chart that was not attached to the agenda item for February 12, 2025.  There is mention of retirement. Although this item is leaving retirement in place, there is a savings to the city because of the city contribution to retirement is reduced as the pay is reduced.

Under Arizona Constitution Article 4, Part 2, Section 17, these changes will not take place until those elected to City Council in the 2026 election take their oaths of office. (The Constitutional section is attached). This constitutional provision, as applied to City Councils, is intended to ensure that all City Council Members "doing, in substance, the same work, should at all times receive the same salaries." (See the penultimate paragraph in Arizona Attorney General Opinion No.I 90-135 dated October 22, 1990, attached). 

The motion at the February 12, 2025, City Council meeting was:

  "I move to disapprove Resolution No. 2353." 

The vote on the above motion was 4 to 3, meaning the resolution was voted down so that the City Council's pay and benefits would remain the same.

Under San Luis City Code § 2.05.440, City Council meetings are conducted in accordance with the parliamentary rules contained in Robert's Rules of Order unless the City Code otherwise specifies. Under the latest edition, edition 12 of Robert's Rules of Order, Sections 35 and 12, in order to propose a change to the February 12, 2025, motion, the cleanest way under Roberts' Rules of Order would be to amend the motion.

RECOMMENDATION / SUGGESTED MOTION:

I MOVE TO AMEND THE FEBRUARY 12, 2025, MOTION (WHICH WAS TO DISAPPROVE RESOLUTION NO. 2353) AND INSTEAD, I MOVE TO APPROVE AND ADOPT THE RESOLUTION REDUCING CITY COUNCIL PAY BY 50%, ELIMINATING CITY-PAID DENTAL AND VISION INSURANCE, AND SUBSTITUTING RESOLUTION NUMBER 2353 FOR NUMBER 2356.
