Discussion and possible action on any and all matters regarding renewal of the subscription to Westlaw for West Publishing and Thompson Reuters online legal library, search engine, and AI services for a 3-year contract. (Kay Marion Macuil, City Attorney)
SUMMARY:
The City Attorney’s and Prosecutor's Offices share a subscription to Westlaw and wish to renew the subscription, which expires August 1, 2025.
Background
Westlaw is a web-based service tool providing searchable access to the laws and other legal resources. Westlaw's databases include constitutions, statutes, regulations, cases, legal encyclopedias, scholarly articles on the law, legal practice guides, forms, legal news and more. The service also includes 24-hour live, bar-admitted, legal reference attorneys. For every attorney license, one paralegal is able to use the service without extra charge. It has been a vital tool of the City Attorney's Office for decades. We use it every day.
In March 2025, I upgraded to include CoCounsel in the service, which is an Artificial Intelligence tool. Using chat retrieves relevant legal resources more efficiently than the search engine, which is also provided with the service. Legal documents can be uploaded to it for reviewing key information and summarizing. The City Attorney and Prosecutor's Offices have been able to use these services without extra cost until the renewal date. Since March, the monthly rate has been reduced from $2,282.47 per month to $2,061.63 per month for three attorneys. The service renews on August 1, 2025, for 3 years.
Renewal
Starting August 1, 2025, the rate would have been $2,577.00 per month for three attorneys with an increase 5% annually through July 28, 2028. However, with two attorneys, the cost is $2,372.00 per month, a savings of $205 per month, $2,460 annually. There will be a 5% increase each year. However, locking in this increase now will prevent higher increases with annual renewals.
Compliance with San Luis Code - Purchasing
Other providers were evaluated, such as Lexis/Nexis and Fast Case. However, those services do not have the copyrights to the references that are most useful for transactional municipal lawyers. Under the San Luis City Code, Purchasing Chapter, Section 36.02, where there is only one service provider, other quotes or bidding are not required.
