ITEM:

Public hearing followed by discussion and possible action on any and all matters regarding Rezoning Case No. 2025-0172. A request by Dahl, Robins & Associates, Inc. on behalf of Regional Center for Border Health to rezone various parcels totaling 20.34 acres in size from Light Industrial (L-I) to Community Commercial (C-2). Located at 249, 250, 310 and 311 S. Oak Avenue in San Luis, Arizona.

SUMMARY:

The applicant is requesting a rezoning of 20.34 acres from Light Industrial (L-I) to Community Commercial (C-2) on four parcels located in the Southwest Arizona Industrial Subdivision Phase 1. Assessors parcel numbers 227-15-007, 227-15-008, 227-15-015, and 227-15-016 with the following addressees at 249, 250, 310 and 311 S. Oak Avenue, respectively. 

This request if approved, will allow the expansion of the existing medical plaza and any of the permitted uses under the C-2 zoning.

GENERAL PLAN:
The land use designation of the subject properties is Commercial (C). The Commercial (C) land use category is intended to provide for the primary commercial areas serving the community including neighborhood, community, and regional-scale development. The request to rezone the subject properties to C-2  is within the range of identified uses, densities and intensities of the City of San Luis 2040 General Plan.

ANALYSIS:
The existing condition of the subject properties is undeveloped vacant land. The lots are part of an industrial subdivision known as Southwest Arizona Industrial Subdivision Phase 1.

REVIEW(S):
As part of the review process, all land use cases are reviewed by various city and outside agencies, no comments have been received.

As required by State Statute, staff sent notification letters to property owners within 300 feet of the proposed project. A total of 27 letters were mailed out. The City has not received any significant concerns or objections from the various review agencies or adjacent property owners.

CITIZEN REVIEW MEETING:
As required by State Statute and City Code, a Citizen Review Meeting was held in City Hall on August 5, 2025, in the City Hall Council Chambers at 6:00 p.m. The intent of this meeting was to allow the public to learn about the project, ask questions, and express any comments. Only one person from the public was present during the meeting. He had no comments or issues.

STAFF RECOMMENDATION:
The applicant has provided the information and material necessary for the review of the zoning request.

Staff recommends approval of Rezoning Case No. 2025-0172 with the following condition:
1. Prior to issuance of any Certificates of Occupancy on the subject parcels, the applicant/owner shall submit a traffic impact study and all recommended right-of-way shall be dedicated to the City of San Luis, and any improvements required by the traffic impact study shall be done by the developer.

RECOMMENDED MOTION:

I MOVE TO FORWARD REZONING CASE NO. 2025-0172 TO CITY COUNCIL WITH RECOMMENDATION OF APPROVAL AS RECOMMENDED BY STAFF.
