Discussion and possible action on any and all matters regarding Ordinance No. 480. An Ordinance of the Mayor and City Council of the City of San Luis, Arizona, amending city code sections 6.05.085 and 10.05.010 to update the definition for Animal Control Enforcement Officer and authorize Transit Enforcement Officer duties. SUMMARY:
BACKGROUND
Animal Control Officers
As our city continues to grow, so does the San Luis Police Department’s need to use personnel effectively. After reviewing the city’s current definitions for animal control and transit enforcement officers, it was determined that the positions aren’t being utilized to the extent permitted under state law. By amending San Luis City Code Section 6.05.085 to reference A.R.S. § 9-499.04, our city’s animal control officers will have a clear avenue to enforce all state statutes regarding animal control in addition to local ordinances.
Transit Officers
Under the current San Luis City Code, transit enforcement officers are defined and designated solely in Chapter 10.15 for parking enforcement. Defining the authority of transit enforcement officers under Section 10.05.010 to include traffic control and traffic investigation will allow the Police Department to assign its peace officers to other, more specialized tasks aligned with their training.
THE PURPOSE OF THIS ORDINANCE
Animal Control Officers
This ordinance amends the San Luis City Code Section 6.05.085 definition for Enforcement Officer to read: “ANIMAL CONTROL ENFORCEMENT OFFICER. Any certified peace officer or any person delegated by the City Manager or his or her designee under the supervision of the Chief of Police, who is responsible for enforcing this chapter, and any regulations promulgated under this chapter, and as authorized for Animal Control Officers under A.R.S. 9-499.04, as it may be amended or renumbered.”
Transit Officers
This ordinance amends San Luis City Code Section 10.05.010 by adding: “(C) Any transit enforcement officer of the City may be authorized by the Police Chief to perform any of the duties of the Police Chief included in this chapter, to the extent authorized for non-peace officers pursuant to A.R.S. § 28-627, as it may be amended or renumbered.”
