ITEM:

Discussion and possible action on any and all matters regarding Resolution No. 2403.  A Resolution of the Mayor and City Council of the City of San Luis, Arizona, approving and adopting an Intergovernmental Agreement with the City of Yuma for the use of pre-approved residential standard plans.  (Jose A. Guzman, Director of Development Services)

SUMMARY:

During the 2025 legislative session, Arizona Senate Bill 1529 was approved and signed into law as Chapter 259.  The bill requires municipalities to establish either standard pre-approved housing design plans or a pre-approved housing design plan program.  The intent of the law is to help streamline the residential permitting process and support the production of additional housing.

Under SB 1529, municipalities may include plans that were developed and pre-approved by other municipalities or agencies in Arizona as part of their local pre-approved housing design plan program.  The law also requires municipalities to process these pre-approved housing design plans administratively.

The City of Yuma has prepared pre-approved residential standard plans that include accessory dwelling units, as well as single-family, two-family, and three-family residential units.  These plans were prepared under the 2024 IRC and 2024 IBC.

Through this IGA, the City of San Luis would be able to use the City of Yuma’s plans for local permitting purposes and to help meet the requirements of SB 1529.  The plans would still need to comply with San Luis zoning requirements, development standards, and any site-specific conditions before permits are issued.  The agreement also makes clear that the plans are provided “as-is,” and the city remains responsible for verifying compliance with its own local requirements.

This agreement provides the city with a practical way to comply with the new State requirement while also giving staff and applicants another tool to make the residential permitting process more efficient.

The proposed agreement includes a one-time compensation amount based on population.  According to Exhibit A of the agreement, the City of San Luis’ share is $28,549.40, based on a population of 41,409, representing approximately 19% of the total project cost of $150,260.00.
