Public hearing followed by discussion and possible action on any and all matters regarding Variance Case No. 2018-0154. A request by Sun State Tower, on behalf of the City of San Luis, owner, for a variance to reduce the required setbacks on property located at 821 N. Garcia Lane, San Luis, Arizona. (Jose A. SUMMARY:
Sun State Towers has requested permission to locate a telecommunications pole to mount antennas and a small structure to house telecommunications equipment at the retention basin located at 821 N. Garcia Lane. They will operate this site for expanding wireless coverage to the area for Verizon Wireless Services both voice and data. The proposed wireless communications facility will consist of an 80-foot mono-elm. The mono-elm will have four (4) Verizon Wireless antennas per sector, and there will be three (3) sectors. The equipment cabinets will be state-approved pre-fabricated equipment cabinets on a concrete slab. The equipment area and the mono-elm will be enclosed with an 8-inch high Concrete Masonry Unit wall for security purposes.
The subject property and all adjacent properties are zoned Medium-High Density Residential. To the north, west and south are all single-family homes. Adjacent to the east is Chicanos Por La Causa Preschool.
The required setback for any structure in the R-2 district is 10 feet street side and 10 feet rear side. However, provided in Section 152.318(C) of the City Code, “towers shall be set back a distance equal to at least one hundred percent (100%) of the height of the tower from any adjoining lot line.” The tower should provide a “fall zone” of its height, in other words, if the tower fails, it would fall entirely on the property on which is located. The proposed tower is 80-feet and the setbacks as proposed are 212-feet to the north, 20-feet to the south, 20-feet to the east and 260-feet to the west; therefore this variance request must be approved prior to construction of the mono-elm for the south and east side setbacks.
TELECOMMUNICATIONS ACT OF 1996:
This federal legislation established certain standards for local review of various types of antennas and other communication devices. Local governments may consider standards such as height, appearance, screening, stealth design, planting, and public safety issues (other than radiation). The local government may not discriminate between service providers, prohibit wireless services or have the effect of prohibiting wireless services, regulate on the basis of electromagnetic radiation if the facility complies with FCC standards, make land use decisions without substantial evidence and a written record of the proceedings, or unreasonably delay decision making on proposed applications.
The applicant has provided the information and materials necessary for review of the variance request. Staff recommends approval of Variance Case No. 2018-0154.

AGENCY REVIEW:
As part of the review process, all land use cases are reviewed by various city and outside agencies. We have received comments from the following agencies:
- City of San Luis Fire Department (5-07-18)
- City of Yuma Development Services (5-07-18)
As required by state statute, staff sent notification letters to property owners within 300 feet of the proposed project (67 letters). Staff received about 7 telephone calls and 1 property owner visit with questions regarding the project. We encouraged them to attend the Citizen Review Meeting and public hearings. The city has not received any other significant concerns or objections from the various review agencies or adjacent property owners.
CRITERIA FOR APPROVAL:
All requests for a Variance from the City of San Luis Zoning Ordinance must meet the criteria for a Variance as set forth in the City of San Luis Zoning Ordinance. A variance is not a right. It may be granted to an applicant only if the applicant establishes compliance with all of the hardship criteria established in A.R.S. §9-462.06 and in Sec 3.5 (C.) of this Ordinance. In all cases, the application shall address all of the following hardship criteria:
- There exist special circumstances or conditions regarding the land or building referred to in the application, which do not apply to other properties in the zoning district.
- The above special circumstances or conditions are preexisting and are not created or self-imposed by the owner or applicant.
- The variance is necessary for the preservation of substantial property rights. Without a variance the property cannot be used for purposes otherwise allowed in this zoning district.
- The authorizing of the variance will not be materially detrimental to persons residing or working in the vicinity, to adjacent property, or to the neighborhood or the public welfare.
The Arizona Revised Statutes (§9-462.06. Board of adjustment) further state that the Board may not:
- Make any changes in the uses permitted in any zoning classification or zoning district.
- Grant a variance if the special circumstances applicable to the property are self-imposed by the property owner.
ANALYSIS:
Staff has reviewed this request and has determined that the request substantially meets the criteria for granting a Variance from the Zoning Ordinance.
1. There exist special circumstances or conditions regarding the land or building referred to in the application, which do not apply to other properties in the zoning district.
The general nature of telecommunication towers is their extreme height. This is needed in order to provide or improve wireless coverage and increase network capacity in an area experiencing deficiencies. There are other means of constructing them which are usually used in extremely dense urban settings (for example, the Phoenix metro area). This usually involves additional telecommunication facilities in order to cover the same area. To avoid an excessive amount of single-user telecommunication towers, the Zoning Ordinance does specify that towers over 40-feet in height shall allow for co-location by other wireless communication providers. (NOTE: at the time that other providers request to place additional equipment on any tower, the Building Safety Division shall require structural review by a qualified party to ensure that the tower is not overloaded.)
2. The above special circumstances or conditions are preexisting and are not created or self-imposed by the owner or applicant.
The specific needs of telecommunication towers to be of a certain height in order to cover a desired service area is a technical matter. It is not an aesthetic (design) issue.
3. The variance is necessary for the preservation of substantial property rights. Without a variance the property cannot be used for purposes otherwise allowed in this zoning district.
As more people rely on smart-phones, tablets, and other wireless communication devices in order to conduct their daily business (including personal business), there will be a need for more telecommunication towers. Where they are located and their height is usually determined by the size of the service area, local topography, and availability of land.
4. The authorizing of the variance will not be materially detrimental to persons residing or working in the vicinity, to adjacent property, or to the neighborhood or the public welfare.
The approval of the variance would not be materially detrimental to the surrounding area or property owners. According to the report submitted by the applicant, “research has shown that around 52% of households are now wireless only for voice service. Households where the median age is 25-34 and adults renting their homes wireless only households are at 70%. According to the National Emergency Number Association 76% of all 911 calls originate from a cell phone number and 64% of all 911 calls come from indoors. The reliability of your cell phone is never more important than when a crisis strikes. That is when a simple call or text can make the difference between life and death.”
The applicant has provided the information and materials necessary for review of the variance request. Staff recommends approval of Variance Case No. 2018-0154.
RECOMMENDATION / SUGGESTED MOTION:
I MOVE TO FIND THE APPLICATION MEETS THE VARIANCE CRITERIA AND TO APPROVE THE VARIANCE AS PRESENTED.
