ITEM:

Discussion and possible action on any and all matters regarding Ordinance No. 384.  An Ordinance of the Mayor and City Council of the City of San Luis, Arizona, amending Chapter 150 Building Regulations, Section 150.011 Building Official; Repealing any conflicting provisions; providing for severability; establishing an effective date; and declaring an emergency. (Kay Marion Macuil, City Attorney)

B. Action on Ordinance No. 384.

SUMMARY:

The Building Official enforces the international building codes as adopted by the City of San Luis.  The current City Code on the Building Official was passed in 1980 only one year after the incorporation of the City (then Town) of San Luis.  At that time the City Clerk designated the Building Official and Council appointed Building Official deputies.  It has been the practice for decades that the City Manager designates the Building Official.  The Assistant City Attorney recently ran across this out-of-date code.  This Ordinance brings the City Code in line with the actual practice.  Because the City Attorney's Office is in the process of filing in court extremely dangerous building code violations, staff requests that the City Council pass the ordinance immediately as an emergency measure.

Under Arizona Revised Statute section 19-142(B) emergency ordinances must have a vote in favor by six (6) of the members of City Council (specifically 3/4 of the entire City City Council). 

RECOMMENDATION / SUGGESTED MOTION:

A.  I MOVE TO APPROVE THE READING OF THE ORDINANCE NO. 384 BY TITLE ONLY.

B. I MOVE TO APPROVE ORDINANCE NO. 384 AND DECLARE AN EMERGENCY.
