Discussion and possible action on any and all matters regarding Memorandum of Understanding between the City of San Luis and Comite de Bienestar Inc. for the proposed Lot Split Case No. 2019-0113. (Jose A. Guzman, Director of Planning and Zoning)
SUMMARY:
A Memorandum of Understanding between the City of San Luis, Arizona and Comite de Bienestar Inc. AZ Corp, pertaining to Lot Split Case No. 2019-0013.
A request by Vega & Vega Engineering, PLC, on behalf of Comite de Bienestar Inc., owner, for the review and approval of Bienestar Estates 10 lot split located on the southeast corner of Avenue F and County 24th Street. Assessor’s Parcel Number 227-15-01 is proposed to be divided in two, creating Parcel “A” and Parcel “B”. The property is currently zoned Community Commercial Zoning District (C-2) and Medium Density Residential (R1-6).
The purpose of the lot split is to allow construction of Bienestar Estates 10 Subdivision to be located in the proposed parcel A. Section 7.1 of the Subdivision Regulations of the City provide in part that lot splits may be approved if the division of land is into three or fewer parcels and does not involve right-of-way dedication, utility extension, or other off-site public improvements. The proposed lot split involves future right-of-way dedication, utility extension and off-site improvements, therefore is not allowed to be processed as a lot split under the Subdivision Regulations. The purpose of the Memorandum of Understanding is to make appropriate provision for future right-of-way dedications, utility extensions, and off-site public improvements such that the application for Lot Split Case No. 2019-0113 can be approved.
