Discussion and possible action on any and all matters regarding appointment to fill a vacancy on the Board of the East San Luis Facilities District. (Glenn J. Gimbut, Assistant City Attorney)
SUMMARY:
Background
East San Luis Community Facility District was created in 2007 principally to provide financing for the infrastructure for Bienestar 9B. It is composed of approximately 720 acres and includes lands now owned by Border Ranches, Sam Group, Riedel Construction, Comite de Bienestar, and homeowners in Bienestar 9A and 9B. The bonds issued for Bienestar 9B went into default, and have been under US Bank stewardship/administration since 2012. All financial matters are now “normal.” The CFD still administers the assessments that remain. Those assessments will not retire until about 2027. Meetings are now about two a year. The District Manager is currently Launch DFA in Scottsdale. If there are any questions, Glenn Gimbut is the attorney for the District.
Vacancies on the Board and Recommendation for Appointment
There are two vacancies on the East San Luis Community Facilities District Board. Both Henry Chavez and Gerald Hunt resigned. Remaining Board Members are Russ Jones, Elizabeth Carpenter, and Frank Rascon. The Board recommends Gustavo MacGrew as a replacement for one seat. There are no suggestions for the second seat. Mr. MacGrew is an Insurance Agent doing business here in San Luis. He is aware of the Board's recommendations and is willing to serve on the Board. He is eligible under the statutory qualifications for this position which are that board members cannot own land in the District, they cannot be members of City Council, and cannot be city staff members.

RECOMMENDATION / SUGGESTED MOTION:
I MOVE TO APPOINT GUSTAVO MACGREW TO THE BOARD OF THE EAST SAN LUIS COMMUNITY FACILITIES DISTRICT.
