Discussion and possible action on any and all matters regarding the Memorandum of Understanding between the City of San Luis and MJS Properties Limited Partnership for the proposed Lot Split Case No. 2019-0155. (Jose A. Guzman, Director of Planning and Zoning)
 

SUMMARY:

A Memorandum of Understanding between the City of San Luis, Arizona and MJS Properties Limited Partnership, pertaining to Lot Split Case No. 2019-0155.

A Request by Dahl, Robins & Associates, Inc., on behalf of MJS Properties Limited Partnership, L.P., owner, for the review and approval of MJS Properties lot split located on the southeast corner of County 22nd Street and 4th Avenue. Assessor's Parcel Number 226-01-001 is proposed to be divided in three lots, creating parcel A, B, & C. The property is currently zoned Community Commercial (C-2), Medium Density Residential (R 1-6), and Medium High Density Residential (R-2), and High Density Residential (R-3) Districts.

The purpose of the lot split is to allow construction of a religious institution to be located in the proposed parcel A. Section 7.1 of the Subdivision Regulations of the City provide in part that lot splits may be approved if the division of land is into three of fewer parcels and does not involve right-of-way dedication, utility extension, or other off-site public improvements. The proposed lot split involves future right-of-way dedication, utility extension and off-site improvements, therefore is not allowed to be processed as a lot split under the Subdivision Regulations. The purpose of the Memorandum of Understanding is to make appropriate provision for future right-of-way dedications, utility extensions, and off-site public improvements such that the application for Lot Split Case No. 2019-0155 can be approved.

RECOMMENDATION / SUGGESTED MOTION:
