Discussion and possible directions to staff on any and all matters regarding approval of Resolution No. 2105.  A resolution of the Mayor and the Council of the City of San Luis, Arizona, to approve an Addendum to the Intergovernmental Agreement (IGA) between the City of San Luis and Yuma County for the purpose of providing mandatory weekend and holiday court services for the San Luis Municipal Court. (Nohemy Echavarria, Magistrate)

The City of San Luis has previously entered into an IGA with Yuma County and its Justice Court to provide for weekend and holiday coverage for the San Luis Municipal Court.  Under Rule 4.1 of the Arizona Rules of Criminal Procedure, a person who is arrested must be brought before a judge within 24 hours, even on weekends and holidays. Under this IGA, Yuma County provides a judge and other necessary personnel and materials to conduct hearings on weekends and holidays to cover all of the local courts. The city has entered into this IGA for several years, and under the contract, the city agrees to pay the County based on the caseload as calculated during the fiscal year. Costs vary from year to year but have always been under $2,500.00, with the amount in 2018 being $945.00. Staff is requesting that City Council approve the Addendum for the cost calculated for the last fiscal year in the amount of $945.00.
