Discussion and possible action on any and all matters regarding Ordinance No. 343. An ordinance of the Mayor and City Council of the City of San Luis, Arizona amending Ordinance No. 137 codified in Chapter 91 of the City Code relating to portable toilet regulations; repealing any conflicting provisions; providing for severability; and declaring an emergency. SUMMARY:
At the October 21, 2015 City Council Work Session, the need for the city to start allowing portable toilets within the city limits was discussed. There needs to be sufficient sanitation during the high season for agricultural work. It was estimated that the city is already experiencing 300 buses and 9,000 agricultural workers a day. The current regulations on portable toilets passed in 1996 prohibits portable toilets within the city limits. The only exception is for portable toilets at construction job sites as authorized by the Building Department. Over the years since 1996, the portable toilets that the agricultural companies provide have become more sanitary and kept in better condition.
The attached Ordinance Number 343 proposes to allow the agricultural companies and labor contractors to bring portable toilets into the city hitched to their buses and vans. The Ordinance would continue to prohibit portable toilets in residential areas. The Ordinance requires that the portable toilets be maintained in clean, sanitary conditions without leaking or seeping. It requires when the portable toilets are not in service that they must be kept in non-residential, fenced areas approved by the Building Department. They can only be stored in San Luis for less than 12 months in a year.
Since the agricultural work season has already started, the Ordinance is written to become effective immediately as an emergency measure. Under A.R.S. §19-142(B) an emergency ordinance must pass by a 3/4 vote of the entire council which is at least 6 votes in favor.

There is no appreciable fiscal impact. Increased enforcement will be handled by current Police Department officers and Building Department staff.
