ITEM:

Discussion and possible directions to staff on any and all matters regarding Resolution Nos. 2163, 2164, 2165, 2166, 2167 and 2168 for the creation and order of work for the required improvement districts for Bienestar Estates 11 Subdivision.  (Jose A. Guzman, Director of Planning and Zoning)

SUMMARY:

The Subdivision Regulations require any new subdivision to create improvement districts pursuant to Arizona Revised Statutes Section 48-571 to 48-617, as amended.  Bienestar Estates 11 is part of the East San Luis Community Facilities District therefore a new Community Facilities District is not required, however the following improvement districts are required:

Street Lighting Improvement District- Pursuant to A.R.S. 48-572(A)(7), §48-616 and §48-617
Enhanced Municipal Improvement District- Pursuant to A.R.S. §48-575 and §48-576
Landscape Improvement District- Pursuant to A.R.S. §48-574 

We have received petitions, signed by the owner, for the required improvement district including waiver of any necessity for publication and posting of the Resolution of Intention and the Notice of Proposed Improvements pursuant to A.R.S §48-578.

Resolution No. 2163 Creation of Street Lighting Improvement District
As a requirement of the City of San Luis Subdivision Regulations, a Street Lighting Improvement District is required for new subdivisions. The City has received a petition to form a Street Lighting Improvement District for Bienestar Estates 11 Subdivision. This is the resolution of intention to create Bienestar Estates 11 Street Lighting Improvement District.

Resolution No. 2164 Creation of Enhanced Municipal Improvement District
As a requirement of the City of San Luis Subdivision Regulations, an Enhanced Municipal Services Improvement District is required for new subdivisions. The City has received a petition to form an Enhanced Municipal Services Improvement District for operating and maintaining certain retention basins within the area described as Bienestar Estates 11 Subdivision. This is the resolution to create that district.

Resolution No. 2165 Creation of Landscape Improvement District
As a requirement of the City of San Luis Subdivision Regulations, all developers are responsible to completely landscape their development projects according to the approved plans. In particular, subdivisions are required to provide landscaping along certain arterial and collector streets, in retention basins, and in other locations as provided in city regulations. In addition, developers may provide paths, trails, and other amenities in the common open space areas adjacent to arterial and collector streets. Neighborhood landscape amenities add value to properties, enhance walkability, and improve community aesthetics. 

The state legislature permits the creation of Municipal Improvement Districts for cities and towns to provide a dedicated funding stream for maintenance, repair and improvements of pedestrian malls, off-street parking facilities, retention basins, and parking and parkways. This Improvement District will be utilized for landscape maintenance within Bienestar Estates 11 Subdivision. Residents within the Improvement District will pay a special assessment on their property tax bill.

This resolution authorizes the creation of Bienestar Estates 11 Landspace Improvement District to serve Bienestar Estates 11 Subdivision. After approval of this resolution, a second resolution ordering the improvements is needed to finalize the formation of the Improvement District process. 

Resolution No. 2166 Order of work for Street Lighting Improvement District
Once a resolution creating a Street Lighting Improvement District is approved, a resolution authorizing work and approving the implementation of the district is required. This is the resolution implementing Bienestar Estates 11 Street Lighting Improvement District.

Resolution No. 2167 Order of work for Enhanced Municipal Improvement District
Once a resolution creating an Enhanced Municipal Services Improvement District is approved, a resolution authorizing work and approving the implementation of the district is required. This is the resolution implementing Bienestar Estates 11 Enhanced Municipal Improvement District.

Resolution No. 2168 Order of work for Landscape Improvement District
Once a resolution creating a Municipal Improvement District is approved, a resolution authorizing work and approving the implementation of the district is required. This is the resolution implementing the Bienestar Estates 11 Landscape Improvement District.

These items will be placed in the Consent Agenda of the Regular Council Meeting of April 14, 2021. Each resolution will be listed individually as one item, for a total of 6 items, unless City Council wishes to further discuss these items during the regular meeting.
