ITEM:

Discussion and possible action on any and all matters regarding action to approve a mutual severance agreement with Tadeo Azael De La Hoya.  (Council Member Luis Cabrera, Vice Mayor Africa Luna-Carrasco and Council Member Jose Ponce) Motion to continue negotiations with Tadeo A. De La Hoya

SUMMARY:

At the July 28, 2021, Regular Council meeting City Council passed a motion directing the City Attorney to negotiate and prepare a mutual severance agreement with Mr. De La Hoya and bring it back before City Council on August 11, 2021.

In addition, under San Luis City Code § 2.05.430, Council Member Luis Cabrera, Vice Mayor Africa Luna-Carrasco, and Council Member Jose Ponce requested that this item be placed on the Agenda for August 11, 2021. Please see the attachment for the signatures.

RECOMMENDATION / SUGGESTED MOTION:

I MOVE TO APPROVE THE MUTUAL SEVERANCE AGREEMENT WITH TADEO AZAEL DE LA HOYA.

OR 

I MOVE THAT THE CITY ATTORNEY'S OFFICE CONTINUE TO ATTEMPT NEGOTIATIONS FOR A MUTAL SEVERANCE AGREEMENT WITH TADEO AZAEL DE LA HOYA.

The estimated fiscal impact is as follow:
100-115-50000 Salaries $126,587.33
100-115-50120 Fica $6,992.13
100-115-50115 Medfica $1,835.54
This estimations include seven months of current salary, less withholdings, accrued vacation and sick time, and the cost to cover 18 months of cost of COBRA that the City shall reimburse.
