Discussion and possible action on any and all matters regarding the budget for the prior fiscal year, July 1, 2020, through June 30, 2021, to rescind and correct the dollar amount in the October 13, 2021, motion, adjusting last fiscal year's final budget for the Prosecutor's Office due to salary lines budget overruns.  (Kay Marion Macuil, City Attorney)

SUMMARY:

The Prosecutor’s Office consisted of one (1) attorney (exempt from overtime) and one (1) paralegal (not exempt from overtime) for most of the fiscal year starting July 1, 2020, and ending 2021. Their Legal Secretary started mid-March 2021.

Adjustment Needed for the Salary General Ledger Account Lines
  • COVID-19 conditions created a need to use overtime
Compensatory time was not feasible due to 500 trials set and piling up due to COVID-19 orders delaying trials, and the office had to use overtime. Yuma County experienced high spikes in COVID-19 cases in the summer of 2020 and even higher numbers in December 2020 through January 2021.  Vaccines against COVID-19 were not yet widely available until March and April 2021. The Court system’s administrative orders to halt in-person jury trials were necessary to prevent further disease transmission.
  • Approved addition of staff after the June 2020 final budget approval
After the final budget was passed in June 2020, Council approved the request for additional staff for the Prosecutor’s office in November 2020.  The addition of the Legal Secretary, who started in mid-March, added to the salary-line overrun.

For the final closing budget for the fiscal year July 1, 2020, through June 30, 2021, staff recommends transferring funds from the City Attorney’s Legal Expenses Line to the Prosecutor’s Salary Line for a $7,400.00 total transfer amount.

Dollar Amount Correction from the October 13, 2021, Agenda
This item came before Council on October 13, 2021.  However, the amount the staff recommended was in error.  To make the record clear, staff recommends rescinding the prior motion to have the total correct amount in this action item.

With this final transfer, the Finance Department will close the books on the 2020-2021 budget as the auditors have finished their work on it.

RECOMMENDATION / SUGGESTED MOTION:

I MOVE TO APPROVE TRANSFERRING $7,400.00 FROM THE CITY ATTORNEY'S LEGAL SERVICES GENERAL LEDGER LINE TO THE CITY PROSECUTOR'S SALARY GENERAL LEDGER LINE FOR THE FISCAL YEAR ENDING JUNE 30, 2021, AND TO RESCIND THE MOTION FROM OCTOBER 13, 2021, IN ITS ENTIRETY.
