ITEM:

Discussion and possible action on any and all matters regarding Order No. 2022-10.  An order of the Mayor and City Council of the City of San Luis, Arizona, authorizing and directing the acquisition of all property necessary for the completion of the construction of a portion of County 24th Street and its intersection with Avenue E within the City of San Luis by dedication, donation, purchase, exchange, or under the power of eminent domain as a matter of public necessity.   (Kay Marion Macuil, City Attorney)

SUMMARY:

Order No. 2022-10 allows staff to enter into negotiations or (if necessary) go through the court to condemn land to construct improvements for the intersection of County 24th Street and Avenue E and to obtain the remaining right of way necessary on County 24th Street between Avenue E and Avenue E½ also known as 20th Avenue to complete the north half of County 24th Street.

RECOMMENDATION / SUGGESTED MOTION:

I MOVE TO APPROVE ORDER NO. 2022-10.

FISCAL IMPACT STATEMENT (IF THIS IS A BUDGET TRANSFER, YOU MUST ATTACH THE BUDGET ADJUSTMENT FORM):

Staff has budget for legal costs. The cost of the land is currently not known. For an idea of the costs, the last condemnation for the right of way in this area for County 21-1/2 Street cost less than $50,000. However, the developer needing the access for Santa Cecilia Subdivision to County 24th Street paid the expense under a development agreement in that case. In this case, the traffic study for the Los Mezquites subdivision requires some but not all the right-of-way needed. Also, more land is involved in this case. Staff is developing an ordinance that will help defray the city's cost if the right-of-way is required as part of the development, which staff will bring to the Council in August. Once we know the cost of land staff will return to City Council to request budget reallocation from other projects or authorization to utilize the council's contingency fund if needed.
