ITEM:
Discussion and possible action on any and all matters regarding Resolution No. 2281. A Resolution of the Mayor and City Council of the City of San Luis, Arizona, approving an intergovernmental agreement with Somerton School District #11 regarding assurances for improvement to conform to traffic study for an elementary school on San Luis Land and temporary traffic safety plan. SUMMARY:
Background
Under the city's Building Code, a traffic study was required for Somerton School District to build Sun Valley Elementary School ("School"). The city's General Plan references make Avenue F an arterial road and San Luis Lane a collector road, the location of the School. The traffic study indicated that the school would need to install a traffic light at this intersection once the school expanded from 200 to a 500 student capacity. The required improvements will require acquiring State Land. Since this process will take time, and there exists need for more elementary schools due to the housing growth in the east part of the city, the city issued a conditional building permit so the building could get started. Now the school building is in its final stage.
The IGA
As stated in the IGA, the purpose of the IGA is to allow the School to open with a temporary certificate of occupancy with the conditions of implementing a temporary traffic safety plan pending the construction of the intersection and the installation of the traffic light. The city is accepting Somerton School District's taxing power as an assurance to construct the intersection and install the traffic light. For the warranty period of the final public infrastructure, the Somerton School District will cause their contractor to provide a warranty bond which will be part of the requests for bids. The traffic light will be required after the school acquires the land for the intersection.
At the time of writing this Agenda Item, the staff will be reaching out to Somerton School District to refine the timing of the traffic light installation.
