Discussion and possible action on any and all matters regarding an intergovernmental agreement with the Yuma County Superior Court to provide security guard services due to a vacancy in that position at the San Luis Municipal Court. (Jenny Torres, Acting City Manager)
SUMMARY:
On January 11, 2023, the Arizona Supreme Court ordered the Yuma Superior Court Presiding Judge David M. Haws to take administrative control and oversight of the day-to-day operations of the San Luis Municipal Court due to the resignation of the city's magistrate. The Arizona Supreme Court also ordered any costs associated with operating the San Luis Municipal Court shall be a city cost. (The order is attached to this agenda item).
In June 2023, the security guard position became vacant. Judge Haws and his staff discovered in overseeing the day-to-day operations that there was a need for properly certified professional staff in the position. It is important that the other staff in place now at the San Luis Municipal Court understand the function of that position and see for themselves how that position functions. All but one of the staff have been there less than two (2) years.
By approximately June 19, 2023, the Yuma Superior Court was able to fill the position by rotating its own staff so that there is coverage in the Municipal Court for all five (5) work-week days. However, the Superior Court is able to do this by having its security guards work on their day off.
At the writing of this agenda, the staff is working on the Intergovernmental Agreement. It will have to be approved by an attorney in the Arizona Attorney General's Office, who are the Court's attorneys. However, the City Council is seeing this item now because the city has received the first invoice for the services. The Intergovernmental Agreement will properly document the authorization of this cost in addition to the Arizona Supreme Court Order attached.

RECOMMENDATION / SUGGESTED MOTION:
I MOVE TO APPROVE THE INTERGOVERNMENTAL AGREEMENT WITH THE YUMA SUPERIOR COURT FOR SECURITY GUARD SERVICES FOR THE SAN LUIS MAGISTRATE'S COURT.
