Discussion and possible action on any and all matters regarding Resolution No. 2287. A resolution of the Mayor and City Council of the City of San Luis, Arizona, ratifying an intergovernmental agreement for the City of San Luis to loan a vehicle to the City of Somerton to transport senior citizens to its Senior Center/Nutrition Center while Somerton’s vehicle is being repaired; repealing any conflicting provisions; and providing for severability. SUMMARY:
Background
The City of Somerton ("Somerton") has a Senior Center / Nutrition Center ("Center") for its senior citizens. Somerton transports its senior citizens to the Center for a hot-cooked meal five times weekly. Somerton's vehicle became inoperable and went in for repairs expected to take at least thirty (30) days. Somerton contacted the City of San Luis ("San Luis") for assistance. San Luis has one suitable vehicle to spare for this purpose.
Somerton and San Luis are both self-insured, paying premiums as part of the Arizona Municipal Risk Retention Pool ("Pool") for liability and damage coverages. The Pool was informed of this vehicle loan. If there is damage or injuries while the vehicle is in Somerton's care, Somerton's Pool policy will kick in under the hired and non-owned vehicle coverage. So that the arrangement is clear, the Pool suggested a contract documenting the situation be made.
Request to Ratify through the Resolution
Since it is an agreement between governments, an Intergovernmental Agreement is required, authorized by the governing bodies, in this case, the two Cities' Councils. So as not to interrupt the senior citizens' meal provisions, the Acting City Manager signed the agreement with the Somerton City Manager, and the vehicle went to Somerton.
