Discussion and possible action on any and all matters regarding Ordinance No. 446. An Ordinance of the Mayor and City Council of the City of San Luis, Arizona, adopting a policy for flags on city property; repealing any conflicting provisions; and providing for severability. SUMMARY:
The purpose of this policy is to establish guidelines in order to ensure that the flags are used only for government speech and that they reflect the views, values, and goals of the municipality of the City of San Luis. The city's flagpoles are not intended to serve as a forum for free expression by the public. The city will not display a ceremonial flag based on a request from a third party, nor will the city use its flagpoles to sponsor the expression of a third party. The Ordinance adopting the policy and the policy are attached.
The city will follow controlling law on the subject of flying flags. The relevant statutes are cited in the policy. The Arizona Revised Statute § 38-450 (a recent addition to the law), requires that the Honor and Remember flag be flown at city hall when the United States flag is flown at half-staff because of the death of a member of the United States armed forces. (A.R.S. § 38-450 is attached to this Agenda Item).
