Discussion and possible action on any and all matters regarding Ordinance No. 471. An Ordinance of the Mayor and City Council of the City of San Luis, Arizona, amending certain San Luis City Codes to conform penalties with Ordinance No. 466 and remove references to border taxis to conform with Ordinance No. 437; repealing any conflicting provisions; and providing for severability. SUMMARY:
BACKGROUND
On May 28, 2025, City Council approved Ordinance 466 to amend municipal court fees via San Luis City Code Section 2.30.050; Municipal Court fees and 2.30.060; Court Collection Service Fee. After the successful codification of this ordinance, it was discovered that the current wording of the City Code's penalty sections does not align with these changes, specifically San Luis City Code Sections 5.15.990, 8.10.990, 8.25.100, 9.05.990, 9.25.990, 10.15.990, and 10.30.990.
By amending these sections to conform with the updated city code sections 2.30.050 and 2.30.060, the Court will be able to assess penalties as intended.
On February 8, 2023, City Council approved Ordinance 437 to repeal San Luis City Code Section 5.15.090; Border Area Taxi Vehicle Permit and Regulations. After the successful codification of this ordinance, it was discovered that multiple city codes continue to refer to border taxis, specifically San Luis City Code Sections 5.15.990(B)(3) through (4), 5.15.030, and 5.15.020.
By amending these sections to remove references to the repealed code, the City will ensure these codes remain enforceable.
THE PURPOSE OF THIS ORDINANCE
Amend all penalty sections of the city code that reference a flat civil penalty to include language to allow for the additional fees and surcharges pursuant to SLCC § 2.30.050. Amend all penalty sections of the city code that reference the court assessing a default fee to do so pursuant to SLCC § 2.30.050 for default judgments. In addition, amend all sections of the city code that reference border taxis.
